© RIA Novosti, stringeron Thursday, December 19, the Verkhovna Rada adopted the Electoral code, as amended by President Vladimir Zelensky. With the help of his party “servant of the people” hopes to win the upcoming local elections, although the authors of the bill were ex-speaker Andriy Parubiy, deputies Oleksandr Chernenko from BPP and Leonid Yemets from the “popular front”the Previous composition of the Parliament accepted it “under the curtain” — July 11, but Zelensky vetoed and made the amendments that have already approved the new Parliament with the votes of 330 MPs of all factions and groups.
The new Electoral code envisages the introduction of a proportional electoral system with open party lists for parliamentary elections and the change of electoral system in local elections.
The US promptly responded to the adoption of the Electoral code. “We welcome the adoption by the Verkhovna Rada of the Electoral code, which represents real progress before the local elections of 2020 and is an important step in strengthening Ukraine’s democracy. We look forward to further enhancements of the code for the realization of the aspirations of Ukraine to reform,” reads the statement of the Embassy of the United States.Elections without candidates
Under the new electoral rules, the whole country is no longer divided into 225 electoral districts, from each of which elected one “mazhoritarshchik”, and 27 electoral regions. Political parties participating in the elections should form one nation-wide list of candidates and 27 regional lists. Regional districts almost coincide with the areas only Kiev and Dnipro (Dnipropetrovsk) are divided into two districts each. It is noteworthy that the Crimea formally joins the Kherson under the title South constituency. Taking into account the wishes of the EU, introduced a gender quota of “3+2”: the top five list must consist of three candidates of one sex and two of another. The threshold remains at 5%, and overcome his party’s proportional share of the seats in Parliament, which may soon be reduced to 300 seats.
Voters will simultaneously vote for the party and for specific candidates from the party list in their region, that is, independents will be no more. The right to nominate candidates in parliamentary elections is exclusively assigned to the political parties. In the newsletter after the title of each of the parties will be the cell in which the voter must enter the number of a particular MP from the party list. Thus, it is anticipated struggle with the long-term practice, when the party closed lists is carried out in the Parliament completely unknown or unpopular businessmen — “dark horses” in the lists. In other words, the party list should already shaping voters during the voting, as if by raising the rating of each candidate with their votes. However, if citizens do not enter the room of a particular candidate, their voice “out” political party as a whole. The candidates to whom exactly “leave” these voices will have to decide the party itself. In addition, the first nine candidates in the list of voters is determined. Thus, it is possible to say that the list is only slightly ajar. “Servant of the people” Alexander Kornienko called the decision the result of a compromise with the other factions.”The position of our political force, 1 [the candidate in the “closed” list], we have proposed 1. The position of the colleagues in the Parliament — 10. So we were looking for a compromise, found him on the number 9,” says Kornienko.
The head of Committee of voters of Ukraine Oleksiy Koshel believes that in the “closed” part of the list remains enough places. “In the adopted Electoral code there are many good innovations, but there are things with which we cannot agree. Voting today, the parliamentary faction they relied on their political benefits. Under a beautiful wrapper “open lists” in fact, adopted a more closed electoral system. There are nine places that are guaranteed to pass. Followed by the informal part of the closed lists from the so-called residual votes. But such votes may be around 1.5 million, and it’s 60 seats of five political parties. There are questions and to the formation of regional lists. There may be an absurd situation, when in the first places in the lists will be sponsors, godparents, or simply odious personality. That is, the candidate receiving fewer votes, but with a high place in the list will have higher chances to enter the Parliament. That is, the signs of closed lists much more than open. And small parties, receiving in the election of 5-7% of the vote, the majority of seats will be determined by conventional closed part,” says Purse, commenting on the new code. He also notes that the bill does not improve the difficult situation with the vote of millions of migrant workers — “forgotten voters.”
First of all, edit Zelensky has been reduced to the deletion of items from the bill Parubiy, as inappropriate to the Constitution. The result of the Election code decreased almost twice — with 553 articles to 229. Himself paruby said that the party Zelensky just “make fun” on his bill.
The main comments to the draft Parubiy was to ensure that internally displaced persons did not in fact granted the right to vote, and the candidates were given too much compensation from the budget. In addition, unlike the previous version, the code Zelensky amendments should enter into force from January 1, 2023, and from 1 January 2020, that is, on the eve of local elections.
Also from the code at the last moment removed the edit about the fight with the doppelgangers. It wanted to be “Servants of the people”, due to the fact that in the parliamentary elections, many only pretended to be members of their party. The amendment to the bill, this provision was determined sufficiently vague phrase “the introduction of voter error,” which could be interpreted broadly.
According to the bill as amended Parubiy, the CEC, with the filing of the SBU, could remove candidates from elections without a court decision, if intelligence agencies accuse the candidate of separatism. This provision could become a tool for political repressions against undesirable candidates, but on December 5 this norm Zelensky struck out.”We on the Committee considered a number of proposals which came from the Office of the President. In particular, with respect to the SBU. There was a rule that SBU can send letters concerning separatism. The election Commission was able to withdraw from the race. We got rid of it. After many objections,” said the Deputy Chairman of the faction “servant of the people” Alexander Kornienko.
Control over the local elites
The essence of the bill with revisions Zelensky in fact involves the further exploitation of the brand “servant of the people” to get the majority of deputies at the local level. Under the new rules, local businessmen, who often bribed their constituents of various food packages, now have to ask the party to bribe the already the party leadership to get the checkpoint part of the list. According to political analyst Kirill Ryzhanova, a consequence of the new code will be that the local elite will be forced to go cap in hand to “servants of the people”.
“The proportional system gives the signal, as local elites and major political players that you can’t even run without a major party. For this reason, they want to negotiate with the “Servant of the people,” said Rezanov.
Cancel “mazhoritarka” in the local elections, according to political expert Valentin Krasnoperov, now advantageous, above all, “servants of the people”, although the new code is lost representation at the local level. “Social, communal, cultural and many other issues are tied to a specific territory,” said Krasnoperov.Analyst Andrey Zolotarev believes that the Election code aims to reformat the Ukrainian policy in General. “This code will allow the team Zelensky to provide rotation of political elites in the country”, — said Zolotarev. In fact, such a rotation implies a further consolidation of power “servants of the people”. Local businessmen this will “drive” the party that is likely to make it even more heterogeneous. The candidates of the party will have to fight among themselves for a passage that clearly will not contribute to the sustainability of most of the party structure. There is also a risk that local councils will become even more detached from their direct constituents. However, benefit and competitors “Servants of the people”, many of whom also supported the bill. On the ground and in the provinces are traditionally strong positions of the party of Yulia Tymoshenko “Batkivshina”, which now actively opposes the privatization of land, mirroring, including the interests of the local “barons”-tenants. The new electoral code is likely to help Yulia Tymoshenko, “overgrown” former constituencies. Says MP from the “Servants of the people” Alexander Kachura, that her party is currently negotiating with the majority organized to “act” in local elections.Dmitry Kovalevich
