It is envisaged that the court will provide approval for the verification of business
The Verkhovna Rada of Ukraine suggest to create a single Higher specialized court on intellectual property and economic competition.
In particular, the parliamentary Committee on economic development held a public discussion of competitive and antitrust reform.
“It is proposed to create a single Higher specialized court on intellectual property and economic competition, which will consider all disputes in the field of competition and state aid to business entities (except for the appeal procedure of public procurement). This court will consider competitive disputes in both the first and appellate instances”, – is spoken in the message.
So, it is envisaged that the court, at the proposal of the Chairman of the Antimonopoly Committee of Ukraine, will provide approval for the verification of business; will consider private claims for competition infringements, compensation of the harm caused to businesses/ consumers by breaches of competition law; will have the opportunity to study the commodity market and the conduct of economic analysis.
We will remind, in February, the Parliament supported the second re-reading the bill number 6746 on protection of economic competition. He was voted 248 deputies. The document provides for amendments to the basic laws in the sphere of protection of economic competition and consolidate these laws the rights of persons involved in cases before bodies of the Antimonopoly Committee of Ukraine, guarantees of these rights and mechanisms of implementation of such rights.
At the beginning of November in the Parliament it was announced the hearing of the report of the head of the AMC for the performance of its obligations.
