Archival photoGerman Parliament passed a bill that outputs the segment of the pipeline “Nord stream — 2” from under the Gas Directive of the European Union.The document wanted to take last week, but this did not happen – the voting took place in the second hour of the night and the Parliament lacked a quorum due to the requirement of the “Alternative for Germany” a roll-call vote. Wednesday ADH also requested a roll-call vote, but at the last moment withdrew the request. In the end the deputies voted, getting up and expressing their position.
The bill States that the rules of the Directive temporarily (for a period not exceeding 20 years) does not apply to “located on the territory of the German part of” pipelines, if:— the first point of connection of such pipe with the EU is in Germany;— the pipeline was built before may 23, 2019;— there are objective grounds for such an exclusion (amortization of the investments made, considerations of security of supply).— the exception will not have adverse effect on competition and security of supply the EU.This formulation corresponds to the content adopted by the EU amendments, but differs in the build. Thus, the EU Directive will allow to make exceptions for:— completed before may 23, 2019 piping the country in which the pipeline is connected to the European network “on the part of the pipe located within the territory or territorial waters (corresponding to States) for objective reasons, such as the provision of depreciation of investments or for security reasons, given that this exemption will not harm competition or the effective functioning of the internal natural gas market or supply security of the Union.”In the recommendations of the Committee on economy and energy fraction of the ruling CDU/CSU says that the bill is consistent with the Directive.So, “the Nord stream — 1” is exempt from the requirements of the energy package already built the pipeline. As for the “Nord stream — 2” Directive will not apply only for a period of 12 nautical miles in the territorial waters of Germany.

In the opinion of the operator, it significantly reduces the likelihood of such exceptions.2 Nord Stream AG, the sole shareholder of which is Gazprom, said that “the Nord stream — 2” is entitled to withdraw from the scope of the updated guidelines, because the project was invested before the new legislation entered into force.The project “Northern stream — 2” involves the construction of two pipelines with a total capacity of 55 billion cubic meters of gas off the coast of Russia through the Baltic sea to Germany. It is planned to finish in 2019. The pipeline passes through the territorial waters or exclusive economic zones of Russia, Finland, Sweden, Denmark and Germany.
